General Sales Terms via Smartphone or Tablet Application.

  1. Definition and subject of the contract

These general conditions apply to the online sale contracts (hereinafter: "Contracts") via the Producer 1159vi tablet and smartphone application (hereinafter referred to as "Producer") by means of distance communication techniques. The contracts are signed between Casarotto Roberto snc Casarotto Cristian and Denis (hereinafter referred to as "Casarotto"), headquartered in Via Monte Grappa 7 / b 36050 Quinto Vicentino (Vicenza, ITALY), P.IVA 03632410241, and consumers / buyers / customers (hereinafter referred to as "Customers") who wish to purchase products from the same and / or personalized and commercialized products (hereinafter referred to as "Products"). Contracts concluded with Casarotto through the application for Tablet and Smartphone Producer (hereinafter referred to as "Application") are governed by Italian law and in particular by Legislative Decree no. 70 (rules on e-commerce).
If the Customer is a consumer, or a natural person acting for purposes other than his / her professional activity, the Contract is also governed by the provisions of D.Lgs. 6 September 2005, no. 206 (hereinafter: "Consumption Code").

These General Sales Conditions (hereinafter "General Terms and Conditions") and in particular the information provided in Art. 52 of the Consumption Code will be displayed visibly on the Site and will be valid and effective until they are modified and / or integrated by Casarotto.

Any changes and / or additions to the General Terms will be effective with immediate effect and will apply to sales made from that date. In any case, the updated version of the General Terms and Conditions will be available on the application Producer

  1. Subjects

The products are sold directly from Casarotto.
The products are sold to the customer identified by the data entered when compiling and sending the order in electronic format, which determines the simultaneous acceptance of these General Sales Conditions.

Product offers on this site are for customers only. Minors to be able to buy on the site must first have the consent of one of their parents or a legal guardian. By making an Order through this application, you are guaranteed to be of age and to have the legal capacity to enter into binding contracts. The Customer is prohibited from entering false, and / or invented, and / or imaginative names, in the online order procedure and in further communications.

By accepting these Terms of Sale, the Customer also exempts Casarotto from any liability arising from the issue of incorrect tax documents due to errors relating to the data provided at the time of the Order's insertion, as the Customer is solely responsible for their correct inclusion.

  1. Sale via electronic commerce service through application for smartphones and tablets.

An online sale contract means a distance contract for the sale of movable property between the Customer and Casarotto as a Seller in the context of an e-commerce service organized by the Seller that, for this purpose, employs Internet-based remote communication technology through the smartphone and tablet application. In order to conclude the purchase agreement for one or more Products, Customer will have to complete the customization phase in which he is proposed to send a request to the factory (hereinafter referred to as "request"). This document contains the files you can recreate the user-designed object and a text file containing the text of your personalized engraving and the user-selected email address on which to receive communications from the manufacturer. From this moment on, the jewel-making process comes out of the scope of application. In fact, with the files received, attached to the request, a factory manager will upload the project to the system and, once the object is analyzed, it will include a report on the feasibility they will be exposed in: realization problems, any project variations and some suggestions or tips, for example on engraved writing position, the firm will then return the report to the requesting user, enclosing a detailed quote (hereinafter referred to as "pricing") of the jewel in terms of time and cost, and some possible payment solutions. Only when the user has to accept the quote and then executes the final order (hereinafter: "order") and agrees with a payment method that will be sent an e-mail with the final quotation and agreed payment methods and (hereinafter: Order Confirmation), the object will be undertaken and consequently required to honor payment agreements.

For the purchase of one or more Products through the application, the registration must be made in advance, providing Casarotto, in compliance with applicable personal data protection provisions, all the data necessary to allow Casarotto to execute (you will find the registration form attached to the response following the project analysis request)

  1. Payment Methods

Payment may be made by bank transfer in advance, unless otherwise agreed upon.

In the case of order by payment by bank transfer in advance, the payment of the agreed amount must be made no later than 5 working days following the order confirmation that will follow, otherwise the contract must be understood automatically resolved and ineffective and the Customer will receive a cancellation order mail from the Order. The products will only be shipped after the payment of the amount of the payment on the current account. The reason for the transfer should indicate the following: the name and surname of the person who made the order; order number; date of order.

  1. Sales Prices

Unless otherwise stated, all the prices indicated in the application, in the window showing the details of the product requested, are to be considered as a result of a simulation and therefore indicative, approximate and subject to change. Casarotto reserves the right to define the final price after a review of the request and by sending the customer a quote. These prices contained in the quote are to be considered VAT included and expressed in Euro. Product prices and shipping and delivery costs may vary without prior notice.


All Products are shipped directly from Italy. The prices of the Products and the shipping and delivery costs indicated in the quote and in the following order, unless otherwise specified, shall be deemed not to include any costs related to customs duties and taxes where the shipment takes place in non-EU countries or in countries where the current legislation provides for import charges. These costs are then borne by the Customer and must be paid directly at the time of delivery of the Products, according to the directions specified in the quote and Order Confirmation.

  1. Shipments and delivery of products

Each shipment contains the ordered products, the relevant transport document, any accompanying documentation required by the country of shipment, any information material and marketing.

Purchased products will be delivered by the courier chosen by Casarotto to the shipping address indicated by the Customer on the order.

In the event that there was no one at the time of the first delivery, the courier will leave a notice of passing. This sheet indicates when the courier has passed and specifies that it will continue to pass in the next 24 hours. If there is still no one at home for the second time, the order will be returned to Casarotto or placed in the warehouse at the shipper's warehouse and any additional storage costs will be charged to the customer.

Casarotto will not be responsible for the failure or delayed delivery due to causes of force majeure, such as strikes, public authority measures, rationing or shortages of energy or raw materials, transportation difficulties, fires, floods, floods and damage to industrial machinery not dependent on Casarotto and will promptly inform the Customer of the occurrence and failure of a cause of force majeure.

  

  1. Right of withdrawal

If for any reason the Customer is not satisfied with the order, or in the unfortunate case where products that do not conform to the requirements are delivered, pursuant to Art. 64 of Legislative Decree no. 206/2005, the Customer has the right to withdraw from the contract without any penalties by following the instructions given below:

  1. a) Returns can be made within 15 business days of arrival.
  2. b) Casarotto will refund the full cost of the products returned by the Customer, unused and unharmed, as well as accompanied and included in the original packaging and the relevant receipt / note of payment / invoice.
  3. c) Customer can exercise the right of withdrawal by simply writing an email to support_producer@1159vi.it and specifying the order of reference.
  4. e) Returns will only be accepted if confirmed by Casarotto.
  5. f) Refunds will be made on the same payment method as the purchase.
  6. g) Casarotto will undertake to promptly repay the Customer within and not more than 30 days from the date of return of the product.
  7. h) The costs of returning the products are the responsibility of the Customer.
  8. Warranty for any products that are not compliant

Casarotto is liable for any defects in the products agreed upon prior notice and order confirmation, in accordance with Italian law. If the Customer has entered into a contract as a Consumer (meaning any natural person acting on the Site for purposes other than his / her business or profession), this warranty is valid on the condition that both of the following conditions are met : the defect occurs within 24 months from the date of delivery of the products; the Customer submits a formal complaint about defects within a maximum of 2 months from the date on which the defect was received by the latter; c) Required correctly. In the case of non-compliance, the Customer who has entered into the contract as a Consumer will be entitled to obtain the repair of the products without charge, repair or replacement, or to obtain a 'appropriate price reduction or termination of the contract in respect of the disputed goods and the consequent repayment of the price. All return costs for defective products will be borne by Casarotto.

 Specifically, since the products offered in the application, unique and original handmade raw materials, these may be subject to minor discrepancies from the image proposed by the application: the images in the application are purely illustrative and are not to be considered binding for contractual purposes. Without prejudice to the colors and / or fantasies chosen, Semiperdo Casarotto reserves the right to distribute to the Client products with variations but with similar or superior performance, however always agreed upon through the quote and order confirmation.

  1. Contribution to shipping costs

For national shipments, the contribution are fully included into production costs applies (valid throughout the Italian territory with the exception of some localities and small islands: the specific calculation of the shipping costs is determined in advance and indicating the address to which to target the Products). Similarly, the contribution to international shipping costs are included in production costs (with the exception of some territories: as above, the specific calculation of shipping costs is determined at the order of the order indicating the address to which the Products are intended).

  1. customer communications

Customer acknowledges, accepts and agrees that all communications, notifications, attestations, information, reporting and any other documentation relating to the transactions made regarding the purchase of the Products will be sent to the e-mail address indicated at recording time, with the ability to download information on a durable medium in the ways and limits set by the application.

  1. Settlement of Disputes and Competent Burial

These General Terms and Conditions of Sale are governed by Italian law and will be interpreted accordingly, without prejudice to any other prevailing imperative of the country of habitual residence of the Customer. Consequently, the interpretation, execution and termination of the General Terms and Conditions of Sale are subject only to Italian law and any disputes inherent or consequent to them must be resolved exclusively by the Italian court. In particular, if the Customer qualifies as a Consumer, any dispute shall be settled by the court of domicile or residence of the same in accordance with the applicable law or, at the consumer's choice in the case of action taken by the consumer himself, by the Court of First Instance of Vicenza. If the Customer acts in the exercise of his business, commercial, craft or professional activities, the parties consensually establish the exclusive competence of the Forum of Vicenza.

  1. Edit and update

Casarotto may make changes or amendments to these General Terms and Conditions at any time. Therefore, Customer will only be required to accept the General Sales Terms in force at the time of purchase. The new General Sales Conditions will be effective from the date of publication on the application and in relation to purchase orders submitted after that date.

  1. Intellectual Property Rights

All content rights on the application and on the site (such as texts, videos, images) are subject to copyright and other intellectual property laws and are reserved for the operator or legitimately entitled to the rights concerning. It is forbidden for the user to modify or delete badges, marks or other indications. The use of the content - in any way - is not permitted except where Casarotto has expressly permitted it.

  1. Privacy

The files that the application sends to the factory at the time of requesting a quote using the application itself, contain only the settings of the various components used in the project, does not include any file containing information about the device on which it is running, has no right to use the user's data, which he only asks for a mail address to return the report on the feasibility of the project.
